I think my ex is trying to hide assets – can I still mediate?
Mediation, is just the same as the traditional legal process. It requires you both to disclose all your financial information, in full.
Not all cases are suitable for mediation and the initial appointment will enable the Mediator to determine whether or not mediation is the best option for you both.
If you are aware your ex is trying to hide assets, you should address your concerns to the Mediator. If it is apparent that information is being withheld, hidden, or is not forthcoming, the Mediator will terminate mediation.
Not all cases are best dealt with in the Court. This is why clients are expected to see a mediator, first of all, before embarking on the court process.
The Courts will come down heavily on spouses who try to hide their wealth from their ex. This has been seen with some divorce cases, recently reported in the media.
Mediation is about helping you to achieve a fair agreement. It encourages you to treat one another with respect, even if you no longer like one another.
Mediation is now regarded as the preferred option, rather than engaging in a legal or court battle.
Mediation is not about being devious, scoring points, raking over the past. Nor is is about attaching blame to anyone. It is about helping you resolve your issues, amicably. We help you both to focus on your future.
Mediation meetings take place in a confidential and safe environment.
You have a choice. You can decide whether or not you want a very public and expensive legal fight.
Alternatively, you could both resolve your matters through mediation. It may well be in both your interests to consider mediation.
Mediation is a more dignified route to resolving your issues.
