• Furlough Leave

    Just a brief note to warn you of two common mistakes employers are making when it comes to furlough leave. The first is not getting employees to agree to furlough leave.  Just telling them they are on furlough leave is not enough.  You need their signed consent in writing.  Otherwise you may find that they were not actually furloughed and any payments you received from the Government may have to be repaid.
     
    The second common mistake is not getting employees to agree to a temporary reduction in their pay.  If you just tell them they will be getting 80% of normal pay (capped at £2,500) the balance of their pay will still be due.
     
    Many employers are getting this wrong and may face constructive dismissal claims and/or unlawful deduction from wages claims.
