Everyone is being encouraged to take on Apprentices, for the benefit of the company and the individuals on the training agreement; however changes have come into force as of this April with the Apprenticeships (Form of Apprenticeship Agreement) Regulations 2012 which updates the original Learning Act 2009. Clarification has now been given. An ‘apprenticeship agreement’ entered into under the Act is a "contract of service", not a ‘contract of apprenticeship’. This distinction is important as a contract of service can be terminated ‘on notice’ – ensuring a correct procedure is followed – on the other hand, an employer may find themselves ‘tied’ into the full term of a contract of apprenticeship – very frustrating if the work or learning is not being done! So.... if you are based in England or Wales and wanting to pass on a skill, trade or occupation - a correctly worded apprenticeship agreement will ensure protection to your organisation.
